These Terms of Use (“Terms”) govern your access to and use of CubaPlay. BrainTech Systems, LLC (“we”, “our”) owns and operates CubaPlay. By using CubaPlay, you acknowledge and agree to these Terms.

1. About CubaPlay

CubaPlay is an independent entertainment app that organizes publicly available Cuban YouTube channels and displays selected independent news headlines from public RSS feeds.

All YouTube videos are displayed using the official YouTube player.
All news articles open in an in-app browser that loads the publisher’s original website.

We are not affiliated with YouTube, Google LLC, or any news publisher featured in the App.

2. Permitted Use

You may use CubaPlay to:

Browse public YouTube channels

Watch videos using the official YouTube player

Save channels as favorites

Explore app categories and curated content

View headlines from public news RSS feeds

Open news articles in the original publisher’s website

3. Prohibited Actions

You agree NOT to:

Download, copy, or attempt to extract YouTube videos

Host, modify, or redistribute YouTube content

Copy or republish news articles displayed in the App

Scrape or reverse-engineer our systems

Misrepresent affiliation with creators, publishers, or CubaPlay

Upload harmful content or attempt to hack the App

Use automated tools to access or collect data

Violation of these Terms may result in immediate account suspension.

4. Content Ownership & Rights

YouTube Content

All video content belongs to the original creators.
CubaPlay does not claim ownership over YouTube videos or metadata.
We only display public information provided by the YouTube Data API.

News Content (RSS)

CubaPlay does NOT host or modify news articles.
All articles are loaded from the original publisher’s website.
All copyrights belong to their respective owners.

CubaPlay only displays:

Headlines

Short summaries

Basic metadata

Full articles are always delivered by the original publisher.

Creators or publishers may request removal of their content from our lists at any time.

5. DMCA / Copyright Removal

If you believe your content appears on CubaPlay in a way that violates your rights, contact us:

6. No Responsibility for External Content

YouTube

CubaPlay:

Does not control video availability

Is not responsible for creator opinions

Cannot guarantee accuracy of metadata

Does not endorse any creator content

All videos are hosted and controlled by YouTube.

News Websites

When you open a news article, it is loaded directly from a third-party website.

We:

Do not control or modify news content

Do not block or remove ads on those pages

Are not responsible for publisher policies or tracking technologies

Do not endorse any views expressed in news articles

Your interactions with third-party websites are governed by their own Terms and Privacy Policies.

7. Advertising & Monetization

Ads appear only on non-video screens.

Ads do not appear on screens containing YouTube audiovisual content.
This ensures compliance with YouTube API policies.

Ads shown inside a news article’s website belong to the publisher, not CubaPlay.

8. Account Suspension

We may suspend or terminate accounts for:

Misuse

Abuse

Security concerns

Violation of these Terms

9. Limitation of Liability

The App is provided “as is” and without warranties.

We are not liable for:

Data loss

API outages

App errors

External news content

Third-party websites

Device damage

Any indirect or consequential damages

Use of the App is at your own risk.
