CubaPlay – Licensing & Copyright Compliance

CubaPlay is owned and operated by BrainTech Systems, LLC and functions as a non-interactive radio streaming application. The app does not host, store, download, or modify any audio content. All playback is delivered through official streaming URLs made publicly available by third-party radio broadcasters.

Our goal is to provide a legal and compliant way for users to discover and listen to Cuban and Latin radio content while respecting the rights of composers, publishers, recording artists, and labels.

How CubaPlay Works

CubaPlay streams radio stations using their official streaming URLs.

Users cannot:

select individual songs,

request specific tracks,

create custom playlists, or

download music.

The listening experience is similar to traditional radio: programmed streams selected by the station, not by the user.

CubaPlay does not upload or host any copyrighted audio files on its own servers.

Because of this non-interactive, radio-style model, CubaPlay operates under the U.S. statutory framework for digital audio transmissions.

U.S. Music Licensing

To legally stream music in the United States, a non-interactive digital service must obtain licenses that cover both:

Musical compositions (songwriters & publishers), and

Sound recordings (artists & record labels).

BrainTech Systems, LLC is in the process of maintaining the following licenses for CubaPlay:

Performing Rights Organizations (PROs) – Compositions

ASCAP (American Society of Composers, Authors and Publishers)
Coverage: public performance rights for works represented by ASCAP.
Status: Active under BrainTech Systems, LLC.

BMI (Broadcast Music, Inc.)
Coverage: public performance rights for works represented by BMI.
Status: License application submitted for CubaPlay as a non-interactive digital audio service.

SESAC
Coverage: public performance rights for works represented by SESAC.
Status: Digital license request submitted; agreement to be finalized with BrainTech Systems, LLC as the service owner.

Together, ASCAP, BMI, and SESAC cover the vast majority of musical compositions used in radio programming in the United States.

Sound Recording Rights – Digital Performance

SoundExchange
Coverage: statutory license for the digital public performance of sound recordings and associated royalties payable to recording artists and copyright owners, under 17 U.S.C. §114 and §112.
Status: Registration as a Commercial, Non-Interactive Webcaster is being initiated for CubaPlay.

Territory

CubaPlay’s radio streaming functionality is intended for listeners in the United States.
Where technically implemented, geo-blocking and/or feature restrictions may be used to limit access to radio streaming features in other territories in order to comply with licensing requirements.

Third-Party Radio Stations & APIs

CubaPlay integrates with third-party radio stations that publish their own official streaming URLs.

Station metadata (such as station name, logo, and tags) may be provided via:

station-provided APIs, and/or

open radio directories (for example, open-source radio directory services).

CubaPlay does not claim ownership of any station branding, audio content, or logos. All trademarks, logos, and content remain the property of their respective owners.

No User-Generated Uploads

CubaPlay does not allow users to:

upload audio files,

stream their own content, or

host custom stations using copyrighted music.

All audio content comes from authorized third-party radio stations.

Compliance for App Stores

This licensing framework is designed to satisfy the legal and policy requirements for:

Apple App Store – non-interactive streaming (radio-style) apps

Google Play Store – apps that stream licensed radio content

CubaPlay operates strictly as a non-interactive radio listener application and is being licensed accordingly through the appropriate U.S. collection societies and statutory licensing bodies.
